Terms of Service

PesaBass lets creators publish and stream music and videos, go live, sell merchandise and digital content, and receive support (gifts, pay-per-view), and lets organisers list events and sell tickets, while audiences discover, watch, buy, and support creators.

Your service provider is CashBass Africa Limited, a company registered in the Republic of Kenya and trading as PesaBass. By creating an account or using the Services, you agree to these Terms, our Privacy Policy, Cookie Policy, Community Guidelines, and any feature-specific terms, all incorporated by reference. If you do not agree, do not use the Services.

• You must be at least 18 to buy, sell, monetise, or transact. Users 13–17 may use basic features only with a parent/guardian's permission and supervision; that adult is responsible for the minor's activity. The Services are not for children under 13.
• You are responsible for the accuracy of your account information, for keeping your password and any two-factor method secure, and for all activity under your account. One person/entity may not keep multiple accounts to evade limits, bans, or fees.
• Business/organisation users confirm they are authorised to accept these Terms on the entity's behalf.

"User Content" means anything you upload, post, stream, list, or submit — videos, audio, images, thumbnails, artwork, product listings, text, and live broadcasts. You keep ownership of your User Content, and you are responsible for it.

You must follow our Community Guidelines. We operate a strike/enforcement system: violations may lead to content removal, feature limits, monetisation suspension, strikes, or permanent account removal depending on severity and history. Using another account to evade a restriction is a serious breach. Appeals may be available in-app.

The Services — our software, design, logos, and trademarks — are owned by PesaBass and protected by law. To report content you believe infringes your rights, email legal@pesabass.music with: (a) identification of the work; (b) the location/URL of the alleged infringement; (c) your contact details; (d) a good-faith statement; (e) a statement that the information is accurate and that you are the owner or authorised agent; and (f) your signature. We remove infringing content and terminate repeat infringers. False notices may incur liability.

• To monetise, you must be approved and complete identity verification (KYC), including a valid government ID where requested.
• You are solely responsible for your content, products, taxes, and any royalty splits you set, and for holding the rights to everything you publish or sell.
• Earnings accrue to your wallet net of platform and processing fees. Payouts are subject to verification, minimum thresholds, and anti-fraud checks. We may withhold or reverse amounts linked to fraud, chargebacks, or policy violations. Fees and revenue shares are shown in-product and may change with notice.

Sellers sell physical or digital goods directly to buyers; the contract of sale is between them. PesaBass provides listing, payment, and messaging tools and is a venue, not the seller, unless expressly stated.

• Sellers must list accurate descriptions, images, prices, stock, and shipping terms; own the right to sell; not list illegal, counterfeit, unsafe, or prohibited goods; and fulfil and honour returns/refunds per their policy and law.
• Buyers agree to pay the listed price plus any shipping/taxes, give accurate delivery details, and follow the Return Policy.
• Disputes are primarily between buyer and seller; PesaBass may, at its discretion, mediate, hold funds, or reverse transactions to protect users.

Payments are handled by third-party processors (e.g. Paystack); by transacting you also accept their terms. Prices are in Kenyan Shillings (KES) unless stated, and taxes are applied as shown at checkout.

• The in-app wallet holds value for purchases, gifts, and PPV; it is not a bank account and earns no interest.
• Gifts are voluntary, generally non-refundable tips. PPV and digital content unlock on payment and are non-refundable once accessed, except as required by law or our Return Policy.
• You authorise us and our processors to charge your chosen payment method, and must not initiate fraudulent chargebacks; abuse may lead to termination and recovery of amounts owed.

Live broadcasts must follow these Terms and the Community Guidelines in real time. You are responsible for everything shown or said on your stream, including by guests. We may interrupt, end, or refuse to host any stream, and may moderate, save, or remove recordings. Recordings are kept only if you choose to save them.

We grant you a personal, worldwide, royalty-free, non-assignable, non-exclusive licence to use our apps and software solely to use the Services. You may not copy, modify, distribute, sell, lease, or reverse-engineer them, or extract source code, except where the law permits or open-source licences (which may accompany certain components) say otherwise. We may update the software automatically.

You may stop using the Services and delete your account at any time (see Data Deletion). We may suspend or terminate access, remove content, or withhold payouts if you materially or repeatedly breach these Terms, if the law requires it, or if your conduct creates liability or harm. We notify you where reasonable. Sections that by nature should survive (e.g. 4, 6, 13–16, 18) survive termination; you may still be able to view publicly available parts of the Services.

WE PROVIDE THE SERVICES WITH REASONABLE CARE AND SKILL, BUT THEY AND ALL CONTENT AND PRODUCTS ARE OTHERWISE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND (MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED/ERROR-FREE OPERATION). We do not endorse and are not responsible for User Content, third-party products, or transactions between users.

Nothing in these Terms excludes liability that cannot be excluded by law (e.g. for death or personal injury caused by negligence, or for fraud). Subject to that, TO THE MAXIMUM EXTENT PERMITTED BY LAW PESABASS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL; AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM OR (b) KES 10,000.

You will defend, indemnify, and hold harmless PesaBass and its officers, employees, and partners from claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your products or transactions, your use of the Services, or your breach of these Terms or of any law or third-party right.

These Terms are governed by the laws of the Republic of Kenya. You and PesaBass will first try to resolve any dispute informally via legal@pesabass.music. If unresolved within 30 days, it will be submitted to the courts of Kenya, or to arbitration in Nairobi under the Arbitration Act where the parties agree. Claims may be brought only in your individual capacity, not as part of a class action, to the extent permitted by law.

We may change these Terms for service updates or legal, regulatory, or security reasons, or to prevent abuse. For material changes we give reasonable advance notice (in-app or by email), except for new features or urgent situations. Continued use after changes take effect means you accept them.

If a provision is unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger, acquisition, or asset sale. We are not liable for delays or failures beyond our reasonable control (force majeure). These Terms with the Privacy and Cookie Policies, Community Guidelines, and any feature-specific terms are the entire agreement between you and PesaBass.
