DMCA / Copyright Policy

PesaBass complies with the Digital Millennium Copyright Act (DMCA) and similar copyright laws worldwide. We respond promptly to valid notices of alleged copyright infringement and have adopted a policy of terminating the accounts of repeat infringers.

As a platform that champions African artists and creators, we take copyright protection seriously. All users must ensure they have the legal right to upload and share content on PesaBass.

If you believe your copyrighted work has been reproduced, distributed, or publicly performed on PesaBass without your authorization, you may submit a DMCA takedown notice to our designated Copyright Agent. Your notice must include:

1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or if multiple works are covered, a representative list.
2. Identification of the infringing material: The specific URL(s) or sufficient information to locate the allegedly infringing material on PesaBass.
3. Your contact information: Your full legal name, mailing address, telephone number, and email address.
4. Good faith statement: A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
5. Accuracy statement: A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
6. Signature: A physical or electronic signature of the copyright owner or authorized agent.

If you believe your content was removed in error or that you have authorization to use the material, you may file a counter-notification. Your counter-notification must include:

1. Your full legal name, address, phone number, and email address.
2. Identification of the content that was removed and its location before removal.
3. A statement under penalty of perjury that you have a good-faith belief that the content was removed as a result of mistake or misidentification.
4. A statement that you consent to the jurisdiction of the courts in Nairobi, Kenya, and that you will accept service of process from the person who filed the original notice.
5. Your physical or electronic signature.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed content.

PesaBass maintains a strict repeat infringer policy:

• First Offense: The infringing content is removed and the user receives a warning notification via email.
• Second Offense: Content removed, account receives a strike, and temporary upload restrictions may be imposed.
• Third Offense: Account is permanently terminated. The user is banned from creating new accounts.

Strikes expire after 12 months. Users may appeal strikes through our Support Center.

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that content is infringing, or that content was removed by mistake, may be subject to liability for damages, including costs and attorney's fees. Do not file a DMCA notice or counter-notification unless you are certain of your rights.

PesaBass is committed to proactive copyright protection. We employ content identification and moderation systems to detect potentially infringing uploads. Artists registered on PesaBass benefit from:
