Advertising Terms

"Advertiser" ("you") means any person or entity that submits, funds, or runs advertising on PesaBass.

"Ad" / "Creative" means the images, video, text, links, and other materials you provide.

"Campaign" means a set of Ads with a budget, schedule, placement, and targeting you configure.

"Placement" means a surface where Ads may appear (e.g. social feed, vibes, page banner).

"Spend" means amounts charged against your advertising balance for impressions, clicks, or other billable events.

You must be of legal age, have authority to bind the entity you represent, keep your account information accurate, and use advertising only for lawful purposes. You are responsible for all activity under your advertiser account and for keeping your credentials secure.

Ads, their landing pages, and the products/services they promote must be lawful, accurate, and non-deceptive. You may NOT advertise, among other things:

• Illegal goods or services, counterfeits, or anything that infringes intellectual-property or other rights.
• Fraud, scams, get-rich-quick or deceptive financial schemes, or misleading claims.
• Hateful, harassing, violent, or discriminatory content; sexually explicit or adult content; content harmful to minors.
• Malware, deceptive redirects, cloaking, or landing pages that differ from what was reviewed.
• Weapons, illegal drugs, or other dangerous, restricted, or regulated products without the right to do so.
• Impersonation, or use of another's brand, name, or likeness without authorisation.

We may publish additional category rules in-product; they form part of these Terms.

You represent and warrant that: (a) you own or are licensed to use all Creatives and the rights they contain; (b) your Ads, landing pages, and offers are accurate, lawful, and comply with all applicable laws and advertising/consumer-protection rules; (c) you will honour any offer made in an Ad; and (d) your use of advertising will not infringe any third party's rights.

We may review, approve, reject, label, reposition, pause, or remove any Ad or Campaign at any time, with or without notice, in our sole discretion — including for policy, legal, quality, or platform reasons. Approval is not an endorsement and does not waive these Terms. We are not liable for rejecting, removing, or not running any Ad.

Ad delivery is provided on a reasonable-efforts basis. We do not guarantee any specific placement, position, reach, number of impressions or clicks, audience, conversion, sales, return on spend, uptime, or business result. Delivery can be affected by budget, targeting, eligibility, demand, moderation, ad-blocking, and technical factors outside our control.

You fund advertising in advance via your advertising balance. Spend is drawn from that balance as billable events occur, up to the budget you set. Amounts already spent on delivered advertising are non-refundable except where required by law or expressly stated by us. Fees, rates, and minimums are shown in-product and may change for future Campaigns. You are responsible for any applicable taxes, and for payment-processor charges, which are non-refundable once collected.

7.2 The Ad Wallet is a separate, spend-only balance. Your advertising balance is distinct from any PesaBass spending wallet or earnings balance: it can only be spent on advertising, cannot be withdrawn to cash or mobile money, cannot be transferred to another balance or user, and earns no interest. Unspent advertising balance remains available for future Campaigns; on permanent account closure in good standing you may request that support review any remaining balance, which we may credit or refund at our reasonable discretion where the law requires. Ad delivery stops automatically when the balance reaches zero.

7.3 Creator Boost. The self-serve "Boost" feature for creators is advertising under this Agreement: boosts are prepaid from the ad wallet, billed per impression at the rate shown when you create the boost, marked as promoted where required, subject to Section 6 (No Guarantee of Results), and moderated like any other ad.

Our measurements of impressions, clicks, and spend are the authoritative basis for billing. We use reasonable methods to detect invalid or fraudulent activity (e.g. bot traffic, repeated self-clicks). We may withhold, adjust, or credit amounts we attribute to invalid activity at our discretion, but we are not liable for invalid activity, ad-blocking, or discrepancies with third-party measurement tools.

You retain ownership of your Creatives. You grant PesaBass a worldwide, non-exclusive, royalty-free licence to host, reproduce, format, and display them to run your Campaign and to show non-confidential examples for operating and promoting the advertising product. PesaBass owns the platform, software, and aggregated performance data; nothing here transfers our intellectual property to you.

We may pause, suspend, or terminate your Campaigns or advertiser account, withhold delivery, or stop serving Ads at any time — including for suspected policy or legal violations, non-payment, fraud, or risk to the platform or its users. You may stop or cancel a Campaign at any time; spend already incurred remains payable.

You will defend, indemnify, and hold harmless PesaBass, CashBass Africa Limited, and our affiliates, officers, and staff from any claims, damages, losses, liabilities, and costs (including reasonable legal fees) arising from your Ads, Creatives, landing pages, products/services, your breach of these Terms, or your violation of any law or third-party right.

The advertising product is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to advertising is limited to the amount of Spend you actually paid us for the specific Campaign giving rise to the claim in the 30 days before the event.

You must not use advertising to collect sensitive personal data or to target users based on sensitive categories, and you must comply with applicable data-protection law (including Kenya's Data Protection Act) and our Privacy Policy. We provide aggregated, non-identifying performance reporting only.

We may update these Terms; continued advertising after an update means you accept it. These Terms are governed by the laws of the Republic of Kenya and should be read with our Terms of Service and Community Guidelines.
