Social Feed Policy
This Social Feed Policy ("Policy") governs user-generated content, interactions, messaging, and community behavior on PesaBass's Social Feed, Stories, comments, and direct messaging features. By using any social feature on PesaBass, you agree to these terms.
1. Scope & Definitions
1.1 "Social Feed" means the PesaBass social timeline where users can post text, images, videos, audio clips, links, and other content visible to followers and the broader PesaBass community.
1.2 "Stories" means temporary content (images, video, text overlays) that expires after 24 hours.
1.3 "User Content" means any content — including text posts, images, videos, audio, comments, reactions, and messages — created, uploaded, or shared by users through social features.
1.4 "Direct Messages" or "DMs" means private messages exchanged between users through PesaBass messaging.
1.5 "Community" means all PesaBass users, including Artists, Fans, Organizers, and Guest users.
1.6 "Vibes" means the PesaBass short-form video feature similar to Reels or TikTok-style content.
2. Acceptable Content & Behavior
2.1 Encouraged Content: PesaBass is a music-first platform. We encourage:
- Music-related posts: new releases, behind-the-scenes, studio sessions, live performance clips
- Artist-fan interactions: Q&As, shout-outs, event announcements
- Creative content: artwork, lyric discussions, music reviews, playlist sharing
- Event promotion and ticket giveaways
- Community celebrations: milestones, achievements, collaboration announcements
2.2 Truthfulness: Users must not post false, misleading, or deceptive content, including disinformation, manipulated media (deepfakes) intended to deceive, or fraudulent promotions. This aligns with the Kenya Computer Misuse and Cybercrimes Act, 2018, Section 22 (publication of false information).
2.3 Respect: All interactions must be respectful. Users may express disagreement, but personal attacks, bullying, and harassment are not tolerated.
3. Prohibited Content
The following content is strictly prohibited on all PesaBass social features. Posting such content may result in immediate removal, account suspension, or permanent ban, and may be reported to law enforcement:
3.1 Hate Speech & Discrimination: Content that promotes hatred, violence, or discrimination based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any protected characteristic. Kenya's National Cohesion and Integration Act, 2008 (Section 13) criminalizes ethnic contempt and hate speech.
3.2 Harassment & Bullying: Targeted abuse, threats, intimidation, doxxing (publishing private information), persistent unwanted contact, or any behavior intended to harm, silence, or intimidate another user. This includes cyberbullying as defined under the Computer Misuse and Cybercrimes Act, 2018, Section 27.
3.3 Sexual & Exploitative Content: Pornographic content, sexually explicit material, non-consensual intimate images, or any content depicting or promoting the sexual exploitation of minors. Content involving minors is subject to mandatory reporting under the Kenya Children Act, 2022 (Section 22) and the Sexual Offences Act, 2006.
3.4 Violence & Dangerous Content: Graphic violence, gore, content that glorifies or incites violence, terrorist content, self-harm or suicide promotion. Incitement to violence is an offence under the Penal Code (Cap 63, Section 96).
3.5 Intellectual Property Infringement: Unauthorized use of copyrighted music, images, videos, or other protected material. This includes reposting others' content without attribution or permission. The Kenya Copyright Act, 2001 protects original creative works.
3.6 Spam & Manipulation: Repetitive unsolicited content, bot-generated posts, engagement manipulation (fake likes, fake followers, coordinated inauthentic behavior), phishing links, malware distribution, or pyramid/referral schemes.
3.7 Illegal Activities: Content promoting, facilitating, or depicting illegal activities, including drug use, fraud, money laundering, or any offence under Kenyan or international law.
3.8 Impersonation: Pretending to be another person, artist, brand, or entity with intent to deceive. Parody and fan accounts must be clearly labeled as such.
3.9 Private Information: Sharing another person's private information (phone number, address, financial details, ID numbers) without their explicit consent, in violation of the Kenya Data Protection Act, 2019.
4. Vibes & Live Streaming
4.1 Vibes Content: Short-form video content (Vibes) is subject to all the same content rules as the Social Feed. Additionally:
- Vibes must not contain unattributed copyrighted music — use PesaBass-licensed catalog or original content
- Challenges or trends that promote dangerous activities are prohibited
- Content involving minors must comply with the Children Act, 2022
4.2 Live Streaming: Live streams are subject to real-time moderation. Users who go live must:
- Not broadcast illegal activity, nudity/sexual content, or violence
- Not stream copyrighted content they don't own or have a license for
- Comply with all applicable broadcasting regulations
- Not broadcast content that would be prohibited under the Films and Stage Plays Act (Cap 222)
4.3 Live Gifting: Live stream gifting is subject to the platform's monetization rules. Gift-for-content arrangements that violate content policies will result in stream termination and may disqualify the user from future monetization.
5. Content Moderation
5.1 Automated Moderation: PesaBass employs AI-powered content moderation to detect and flag potentially harmful content. Flagged content may be automatically hidden pending human review.
5.2 Human Review: PesaBass maintains a content moderation team that reviews flagged content, user reports, and appeals. Moderation decisions are typically made within 48 hours.
5.3 Transparency: When content is removed, the posting user will receive a notification explaining which policy was violated. Content creators may request a more detailed explanation.
5.4 Error Correction: We acknowledge that automated systems may make errors. Users can always appeal moderation decisions (see Section 7).
6. Reporting
6.1 How to Report: Every post, comment, Vibe, Story, and DM has a "Report" option accessible via the three-dot menu. Users should select the most appropriate category when reporting.
6.2 Report Categories: spam, harassment/bullying, hate speech, violence/threats, sexual content, intellectual property infringement, impersonation, false information, self-harm, illegal activity, other.
6.3 Anonymous Reporting: Reports are confidential. The reported user will NOT be informed who submitted the report.
6.4 Mandatory Reporting: In accordance with Kenyan law, PesaBass is obligated to report content involving child exploitation (Children Act, 2022), terrorism (Prevention of Terrorism Act, 2012), or cybercrimes (Computer Misuse and Cybercrimes Act, 2018) to the relevant authorities.
6.5 False Reports: Submitting repeated false or malicious reports to harass another user is itself a policy violation and may result in sanctions against the reporting user.
7. Enforcement & Appeals
7.1 Strike System: PesaBass uses a progressive enforcement system:
- 1st violation: Warning + content removal
- 2nd violation: 24-hour feature restriction (cannot post, comment, or message)
- 3rd violation: 7-day suspension from social features
- 4th violation: 30-day suspension from social features + monetization review
- 5th violation: Permanent ban from social features; full account review
7.2 Severe Violations: For egregious violations (child exploitation, terrorism, credible threats of violence), PesaBass may immediately permanently ban the user and report the matter to law enforcement, bypassing the progressive strike system.
7.3 Appeals: Users may appeal any enforcement action within 30 days by submitting an appeal through the Support Center. Appeals are reviewed by a different moderator than the one who made the original decision. Appeal decisions are typically issued within 5 business days.
7.4 Reinstatement: Users whose social feature access has been suspended may apply for reinstatement after completing the suspension period. Reinstatement is not guaranteed and depends on the nature and severity of past violations.
8. Intellectual Property in Social Content
8.1 Ownership: Users retain ownership of their original User Content. By posting on PesaBass, you grant PesaBass a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content within the platform and in PesaBass marketing materials (e.g., social media previews, app store screenshots).
8.2 Third-Party Content: Users must have the right to share any content they post. Reposting or sharing another creator's work requires proper attribution and, where applicable, permission. The "Share" feature on PesaBass automatically attributes the original creator.
8.3 DMCA & Copyright Takedowns: PesaBass complies with the DMCA and Kenya Copyright Act, 2001. Copyright holders may submit takedown requests through our DMCA process. Counter-notifications are supported for users who believe their content was removed in error.
8.4 Music in Posts: When users include music in their social posts or Vibes, the music must be: (a) from the PesaBass licensed catalog, (b) original content created by the user, or (c) used with the copyright holder's permission.
9. Data Protection & Messaging Privacy
9.1 Public Content: Social Feed posts, Vibes, and Stories are public by default (visible to all PesaBass users). Users may adjust visibility settings where available.
9.2 Direct Messages: DMs are private between participants. PesaBass does not read or monitor DMs proactively. However, DMs reported by a participant may be reviewed by moderators to investigate policy violations.
9.3 Data Collection: Interaction data (likes, comments, follows, viewing patterns) is collected to personalize the Social Feed and improve recommendations. This data is processed in accordance with the Kenya Data Protection Act, 2019 and our Privacy Policy.
9.4 Data Retention: Social Feed posts are retained as long as the user's account is active. Stories expire after 24 hours. Deleted content is removed from public view immediately and purged from backup systems within 30 days.
9.5 Right to Erasure: Users may delete their own posts, comments, and messages at any time. Upon account deletion, all User Content is removed in accordance with our data retention policies and applicable law (DPA 2019, Section 40; GDPR Article 17).
10. Advertising & Sponsored Content
10.1 Disclosure: Users must clearly disclose paid partnerships, sponsorships, or any material connection to products/services they promote. Posts must include #ad, #sponsored, or use PesaBass's built-in "Paid Partnership" label.
10.2 Prohibited Advertising: Users may not advertise: illegal products/services, competing music platforms, gambling or betting services (without regulatory approval per the Betting, Lotteries and Gaming Act, 1966), weight loss supplements, financial schemes, or any product/service that violates PesaBass policies.
10.3 Influencer Responsibility: Artists and influencers promoting products are responsible for ensuring claims are truthful and not misleading, in compliance with the Kenya Consumer Protection Act, 2012 and the Advertising Standards Body of Kenya guidelines.
11. Governing Law
11.1 This Policy is governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles.
11.2 Where this Policy references specific Kenyan legislation, the most current version of such legislation applies, including any amendments, successor statutes, or subsidiary legislation.
11.3 To the extent any provision of this Policy conflicts with mandatory consumer protection or data protection rights in the user's jurisdiction, the user's mandatory local rights prevail.
11.4 This Policy supplements (and does not replace) the PesaBass Terms of Service and Community Guidelines.
